:Description
This advice aims to monitor the awareness and observations of customers
regarding the UAE Labour Law limiting working hours per day in the private
sector to eight working hours, not exceeding 48 hours per week, and the normal
working hours are reduced by two hours during the month of Ramadan. Whereas,
Article 17 of Federal Decree-Law No. (33) of 2021 regarding the organization of
labour relations "UAE Labour Law" specified working hours per day in the
private sector to eight working hours per day, or 48 hours per week. The daily
working hours may be increased or decreased for some economic sectors or some
categories of employment, in addition to the working / rest times and the hours
during which work is prohibited for certain categories of employment, according
to the classification of employment that is specified in the executive
regulations of the Decree-Law. The periods that the worker spends in commuting
between his place of residence and the place of work are not counted among the
working hours, except for some categories of workers according to the controls
specified by the executive regulations of the decree-law. In cases where the
worker works in other than a full-time job, it is not permitted for the
original employer or another employer for whom the employee works to demand that the worker work for him more than
the hours agreed upon in the employment contract,
except with the written consent of the worker. In the event that the worker
wishes to perform his work remotely, whether from inside or outside the
country, and with the approval of the employer, the employer may stipulate
specific working hours. It is also not permissible for the worker to work for
more than 5 consecutive hours without a period or periods of rest that are not
less than an hour in total, provided that these periods are not included in the
calculation of working hours, and the working hours and rest periods are
regulated in the establishment that operates on a shift system, or for some job
categories according to their nature - such as field jobs - and according to
the employment classification specified in the executive
regulations of the
Decree-Law.
As for additional
working hours, the employer may employ the worker for additional working hours
over normal working hours, provided that they do not exceed two hours per day,
and he/she may not be employed for more than that except in accordance with the
conditions and controls specified by the Executive Regulations of the
Decree-Law regulating labour relations. In all cases, the total working hours
must not exceed (144) hours every three (3) weeks. If work conditions require
the worker to work for more than the normal working hours, the extra time shall
be considered overtime for which the worker shall receive a wage equal to the
wage corresponding to the normal working hours, according to the basic wage,
plus an increase of not less than (25%) of that wage. If work conditions
require the worker to work overtime between 10:00 pm and 4:00 am, the worker
shall be entitled to the prescribed wage for the overtime in relation to the
normal working hours, calculated
